Terms of Service
1. Introduction & Acceptance
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Miguel Jose Leal da Silva, autónomo registered in Spain, VAT ESZ2417972X ("StreamSquire," "we," "us," or "our"), governing your access to and use of the StreamSquire platform, including the local agent software, cloud relay services, dashboard, and website at streamsquire.app (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service. We recommend that you save or print a copy of these Terms for your records.
2. Service Description
StreamSquire is a local-first streaming toolkit that monitors live chat across multiple platforms (Twitch, YouTube, Kick, TikTok), detects highlight moments using AI, and automatically clips directly from your local OBS recording at source quality.
The Service consists of two components:
- Local Agent — a Rust-based desktop application that runs alongside OBS on your machine. It performs chat monitoring, audio analysis, clip extraction, and serves the local dashboard.
- Cloud Relay Service — optional cloud infrastructure that enables features such as remote dashboard access for moderators, role-based permissions, cloud clip storage, AI-powered stream summaries, managed AI processing, and cloud speech-to-text transcription. The cloud relay is a proprietary service operated by StreamSquire.
3. Beta Disclaimer
StreamSquire is currently in public beta. The Service is provided "as-is" with no warranty of any kind, express or implied. During the beta period:
- Features may change, break, or be removed without prior notice.
- Data formats and APIs are subject to change between releases.
- There is no uptime guarantee for cloud relay services. Scheduled and unscheduled maintenance may occur at any time.
- We may reset, migrate, or delete cloud-stored data during the beta period with reasonable notice.
- Performance, reliability, and feature availability may vary as we iterate on the product.
By using the Service during the beta period, you acknowledge and accept these conditions. We strongly recommend maintaining your own backups of any important data.
4. Accounts
Certain features of the Service require you to create an account. Account creation and authentication are handled via OAuth through third-party providers, including Twitch, Google (YouTube), and Kick. StreamSquire does not store your passwords.
You are responsible for:
- Maintaining the security of your connected OAuth accounts.
- All activity that occurs under your StreamSquire account.
- Notifying us promptly at [email protected] if you suspect unauthorized access to your account.
You must be at least 16 years of age (or the minimum age required in your jurisdiction) to create an account. By creating an account, you represent that you meet this age requirement.
5. Subscriptions & Billing
StreamSquire offers paid subscription plans for premium features. All payment processing is handled by Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record for all transactions. Paddle's Terms of Service and Privacy Policy govern all billing, payment processing, invoicing, and tax collection.
Key billing terms:
- Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your selected plan).
- Paddle handles all applicable taxes (VAT, sales tax, etc.) based on your location.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- We offer a 14-day refund policy from the date of purchase. See our Refund Policy for full details.
- Prices may change with 30 days' notice. Existing subscribers will be notified before any price change applies to their renewal.
6. Free Tier
StreamSquire offers a free tier that includes full use of the local agent and local dashboard. The free tier is free forever — it is not a trial and does not expire.
- No account is required to use the local agent. You can download, install, and run the agent without registering.
- The free tier includes local chat monitoring, local clip extraction, and the local dashboard.
- Cloud relay features, remote access, and certain AI-powered features may require a paid subscription or an account.
- We reserve the right to modify which features are included in the free tier, but will not retroactively remove core local functionality from existing users.
7. Usage Limits & Fair Use
Each subscription tier includes monthly allowances for AI tokens and cloud transcription hours. These allowances are described on our Pricing page and may be updated from time to time.
- Usage allowances reset at the start of each calendar month (UTC).
- Unused allowances do not roll over to the following month.
- If you exceed your tier's allowance, the relevant feature will be temporarily unavailable until the next reset or until you upgrade to a higher tier.
- We reserve the right to adjust usage limits with 30 days' notice. Changes will not apply retroactively to the current billing period.
Manipulating usage limits — including but not limited to canceling and resubscribing to reset quotas, creating multiple accounts, or using automated tools to circumvent limits — is a violation of these Terms and may result in suspension or termination of your account.
8. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party right.
- Abuse, overload, or interfere with the cloud relay infrastructure or any other StreamSquire systems.
- Scrape, crawl, or use automated means to extract data from the cloud relay service beyond normal API usage.
- Redistribute, resell, or sublicense access to the cloud relay service or any proprietary component of StreamSquire.
- Reverse-engineer, decompile, or disassemble the Service or any component thereof.
- Use the Service to harass, threaten, or harm others.
- Circumvent any rate limits, usage quotas, access controls, or security measures, including manipulating billing cycles to reset usage counters.
- Transmit malware, viruses, or other harmful code through the Service.
We reserve the right to suspend or terminate access for any user who violates these acceptable use terms.
9. Intellectual Property
The StreamSquire platform, including the local agent, cloud relay service, dashboard, AI models and prompts, website design, branding, and all associated code and content are the exclusive property of StreamSquire and may not be copied, modified, distributed, or reverse-engineered without explicit written permission.
Your Content
You retain all rights to your clips, recordings, chat data, and any other content you create or process through the Service. StreamSquire does not claim ownership of your content. We only access your content as necessary to provide the Service (e.g., processing clips for AI analysis when you enable that feature).
10. AI Features & Third-Party Providers
Certain features of the Service use third-party artificial intelligence providers to process your data, including Google Gemini for stream analysis and ElevenLabs for cloud transcription. By enabling these features, you acknowledge that:
- Contextual data (chat messages, transcription excerpts, stream metadata) may be transmitted to and processed by third-party AI providers.
- Raw video and audio files are not sent to AI providers. Only text-based context is shared for AI analysis.
- Audio segments are sent to ElevenLabs only when you explicitly enable cloud transcription.
- AI-generated content (summaries, recommendations, clip approvals) may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing all AI outputs before use.
- We may change AI providers at any time. Such changes do not constitute a material change to the Service.
- If you provide your own API key for a third-party AI provider (e.g., Anthropic, OpenAI), your data is sent directly to that provider under their terms. StreamSquire is not responsible for data handling by providers you configure.
11. Social Media Publishing
StreamSquire allows you to publish clips directly to third-party social media platforms, including YouTube, X/Twitter, TikTok, Instagram, and Facebook. By using these features, you acknowledge and agree that:
- You are responsible for all content you publish through StreamSquire. We do not review, moderate, or approve your posts before publishing.
- Platform availability depends on your subscription tier. Free-tier users can publish to YouTube and X/Twitter (local OAuth). TikTok, Instagram, and Facebook require a Pro (Knight) or higher subscription, as these platforms require HTTPS callbacks that are handled through our cloud relay. This is a technical limitation imposed by the platforms, not a StreamSquire restriction.
- OAuth tokens for connected accounts are stored locally on your machine, encrypted at rest. You can disconnect any platform at any time from Settings.
- StreamSquire is not liable for any action taken by a social media platform against your account, including but not limited to content removal, strikes, suspensions, or bans resulting from content you publish.
- AI-generated titles, descriptions, and hashtags are suggestions only. You are responsible for reviewing and editing all content before publishing. AI-generated content may be inaccurate, inappropriate, or violate platform guidelines.
- Each platform has its own terms of service, content policies, and community guidelines. You are responsible for ensuring your published content complies with the relevant platform's policies.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- StreamSquire's total aggregate liability to you for any claims arising from or related to the Service shall not exceed the total fees paid by you to StreamSquire in the twelve (12) months preceding the claim.
- In no event shall StreamSquire be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, regardless of whether such damages were foreseeable or whether StreamSquire was advised of the possibility of such damages.
- StreamSquire shall not be liable for any loss or corruption of recordings, clips, or other data, whether stored locally or in the cloud. You are responsible for maintaining your own backups.
- StreamSquire shall not be liable for any interruption, delay, or failure of the cloud relay service, including during the beta period.
Some jurisdictions do not allow the limitation or exclusion of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
13. Warranty Disclaimer
THE SERVICE IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. We expressly disclaim all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Any warranty that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
- Any warranty regarding the accuracy, reliability, or completeness of AI-generated content, including clip analysis, stream summaries, and automated approvals.
This disclaimer applies with particular force during the beta period, during which the Service is under active development and is expected to contain bugs, incomplete features, and breaking changes. Your use of the beta Service is at your sole risk.
14. Termination
Either party may terminate this agreement at any time:
- You may stop using the Service and delete your account at any time by contacting [email protected] or through the account settings in the dashboard.
- We may suspend or terminate your access if you violate these Terms, or for any reason with 30 days' notice.
Upon termination:
- Your right to access the cloud relay service will cease immediately (or at the end of the notice period, if applicable).
- You will have 30 days from the effective date of termination to export your data from the cloud relay service. After this period, we may delete your cloud-stored data.
- The local agent will continue to function independently, as it does not require an account.
- Any prepaid subscription fees for unused periods will be refunded on a pro-rata basis.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Spain.
If you are a consumer residing in the European Union, you retain all rights granted under applicable EU consumer protection legislation, including Directive 2011/83/EU on consumer rights. Nothing in these Terms limits or waives your rights under mandatory consumer protection laws of your country of residence.
EU consumers may also use the Online Dispute Resolution platform provided by the European Commission.
16. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will provide at least 30 days' notice before the changes take effect. Notice will be delivered via:
- Email to the address associated with your account, and/or
- A prominent banner on the StreamSquire website and dashboard.
Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the changes. If you do not agree with the updated Terms, you must stop using the Service before the changes take effect.
We will maintain an archive of prior versions of these Terms, available upon request at [email protected].
